The City of Toledo has been referring noncompliant Phase I properties, due December 31, 2025, to Toledo Housing Court, and court hearings for those cases are underway. Notices of Violation for noncompliant
Phase 2 properties, with a deadline of June 30, 2026, are in the mail, and property owners will receive their notices soon. Receiving a Notice of Violation or Housing Court summons DOES NOT STOP the certification process; owners must continue working towards compliance immediately rather than waiting for court.
Continuous Compliance: A court referral DOES NOT block certification. Being referred to Housing Court does not prevent the property owner from applying for or obtaining a Lead-Safe Certificate.
Submitting Completed Inspections via the Portal: If an inspection has already taken place, the property owner must promptly submit the Lead-Safe Certificate application along with all required documentation through the City’s Lead-Safe Portal.
Primary Goal of Enforcement: The ultimate goal of enforcement is bringing properties into full compliance with the Lead-Safe Ordinance.
Mandatory Court Appearance and Bench Warrant Risk: Property owners are REQUIRED to appear in court on the scheduled date unless officially notified otherwise by the Court or City; failure to appear may result in a bench warrant.
Strict Adherence to Summons Instructions: Having a Lead-Safe Certificate in hand DOES NOT exempt an owner from attending; owners must follow all instructions on their official summons and court notices… When summoned, go to court!
Inspections Alone DO NOT Equal Compliance: Completing an inspection is NOT the end of compliance; the required documents must be submitted, reviewed, and officially approved by the City through the Portal.
Clearance Reports are NOT Lead-Safe Certificates: A passing Clearance Report from an inspector is NOT a Lead-Safe Certificate; an official application must be processed through the City of Toledo’s Portal.
Ultimate Owner Responsibility: Even if an inspector, property manager, or third party submits the paperwork on the owner’s behalf, the property owner remains LEGALLY RESPONSIBLE for ensuring the final Lead-Safe Certificate is obtained.
Definition of an Active Certificate: A property does not have an active Lead-Safe Certificate until the City has reviewed, approved, and officially issued the Lead-Safe Certificate.
Portal Processing Delays: Owners must APPLY EARLY because heavy application volume can extend City review times, and completing an inspection right before court DOES NOT guarantee a certificate will be issued in time.
Maintaining Inspection Standards and Early Action: Inspectors and property managers must strictly follow all standard inspection and reporting requirements regardless of court urgency; owners should schedule inspections now rather than waiting.
